Terms of Service
Effective date: July 29, 2026
1. About DivvyUp
DivvyUp ("we", "us") operates a platform that connects local businesses with nearby consumers through location-based deals, notifications, and surveys, via our website and mobile app (together, the "Service"). By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Accounts
- You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.
- You are responsible for your account credentials and all activity under your account.
- Business accounts must provide accurate business information and have authority to act for the business they represent.
- You must provide accurate information and keep it up to date.
3. Location Services and Notifications
Core features of the Service depend on your device's location (including background location for geofenced deal alerts) and push notifications. These are optional and controlled by permissions on your device — but if you decline them, location-based features will not work. See our Privacy Policy for how location data is handled.
4. Deals and Offers
- Deals, promotions, and promo codes shown on DivvyUp are created and fulfilled by the participating business, not by DivvyUp.
- The business is solely responsible for honoring its offers, and for the quality, safety, and legality of its goods and services.
- Deals may expire, change, or be withdrawn at any time. Promo codes are single-use unless stated otherwise and have no cash value.
5. Business Use of the Service
- Businesses may create campaigns, geofences, and surveys only for lawful promotion of their own goods and services.
- Businesses must not use survey questions to request sensitive personal information, including health information, financial account details, government identifiers, precise addresses, passwords, or information about race, religion, politics, sexual orientation, or union membership. We may pause or remove campaigns that violate this rule.
- Businesses may not use the Service to send unlawful, deceptive, or misleading offers, or to spam consumers.
- Audience metrics, impression estimates, and analytics are good-faith estimates only and are not guaranteed.
6. Acceptable Use
You agree not to:
- Break any law or infringe anyone's rights while using the Service;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems;
- Spoof your location, automate access, or scrape data from the Service;
- Submit false survey responses or manipulate deal redemptions or analytics.
7. Content
You retain ownership of content you submit (such as business descriptions, deal text, and survey responses), and you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service. You are responsible for having the rights to any content you submit.
8. Termination
You may stop using the Service at any time, and you can request deletion of your account by contacting us at the email below. We may suspend or terminate accounts that violate these Terms, create risk for us or other users, or as required by law. Sections that by their nature should survive termination will survive.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that geofence triggers, notifications, or deals will be delivered accurately, on time, or at all — device settings, operating-system behavior, and network conditions outside our control affect delivery.
10. Limitation of Liability
To the maximum extent permitted by law, DivvyUp will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Continued use after changes take effect means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Wake County, North Carolina.
